Civil liability arising from lawful harmful acts in private law

Dr. Hector Campos, lawyer of our firm, published his article on Civil Liability in the journal ARS Juris Salmanticensis, of the University of Salamanca. “The study of civil liability from a multi-functional perspective implies a review of the assumptions that determine the emergence of a compensatory obligation in the responsible party”, begins Dr. Campos.

According to what he published in the law journal of the University of Salamanca, one of the elements that must be analyzed is that of unlawfulness or unlawfulness. He also states that “if it is conceived that civil liability is no longer a punitive reaction against the conduct that generated the damage, then the recognition of unlawfulness as a conditioning condition for the protection of compensation loses its basis”.
